Introduction
This contractual document governs the General Conditions for contracting services (hereinafter, the «Conditions») through the website artprojectgroup.com, owned by Art Project Group Developers SL under the trade name Art Project Group, hereinafter the PROVIDER, whose contact details also appear in the Legal Notice of this website.
These Conditions will remain published on the website, available to the USER to reproduce and save as confirmation of the contract, and may be modified at any time by the PROVIDER. It is the USER’s responsibility to read them periodically, since the ones in force at the time an order is placed are the ones that apply.
Contracts will not be subject to any formality except in the cases expressly set out in the Spanish Civil and Commercial Codes and in this or other special legislation.
Acceptance of this document means that the USER:
- Has read and understands what is set out here.
- Has sufficient legal capacity to enter into a contract.
- Accepts all the obligations set out here.
These conditions have an indefinite period of validity and apply to all contracts entered into through the PROVIDER’s website.
The PROVIDER states that the business is responsible and is familiar with the legislation in force, and reserves the right to modify the conditions unilaterally, without this affecting the terms and conditions that were in place before the modification.
Identity of the contracting parties
On the one hand, the PROVIDER of the services contracted by the USER is Art Project Group Developers SL, with registered office at C/ Álvaro Mutis 1, 4ºG. Mijas. Postcode: 29651. Málaga (Spain), Tax ID B93651883 and with customer/USER service telephone 952 665 664.
And on the other, the USER, registered on the website with a username and password, for the use and safekeeping of which the USER is fully responsible, and who is responsible for the accuracy of the personal data provided to the PROVIDER.
Purpose of the contract
The purpose of this contract is to govern the contractual sale and purchase relationship created between the PROVIDER and the USER at the moment the USER ticks the relevant box during the online contracting process.
The contractual sale and purchase relationship entails the delivery of a specific service or product in exchange for a set price publicly displayed on the website.
Correction of data
Where the USER identifies errors in the data published on the website or in the documents generated by the contractual relationship, they may report them to [email protected] so that Art Project Group Developers SL can correct them as soon as possible.
The USER can keep their data up to date by accessing their user account.
Contracting procedure
In order to access the services offered by the PROVIDER, the USER must be of legal age and must register through the website by creating a user account. The USER must therefore freely and voluntarily provide the personal data requested, which will be processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and Spanish Organic Act 3/2018 of 5 December (LOPDGDD) on the protection of personal data, as detailed in the Legal Notice and the Privacy Policy of this website.
The USER will choose a username and a password, undertaking to use them diligently and not to make them available to third parties, and to notify the PROVIDER of their loss or theft or of possible access by an unauthorised third party, so that the PROVIDER can block them immediately.
Once the user account has been created, and as required by article 27 of Spanish Act 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow these steps:
- General contracting terms.
- Activation of services.
- Right of withdrawal.

- Purchase process.
- Severability and suspension or termination of the contract.
- Warranties and refunds.

1. GENERAL CONTRACTING TERMS
Unless otherwise agreed in writing, placing an order with the PROVIDER means that the USER accepts these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER unless it has been expressly accepted in advance and in writing by the PROVIDER.
2. ACTIVATION OF SERVICES AND/OR SOFTWARE DOWNLOAD
The PROVIDER will not activate any service until it has confirmed that payment has been made.
Since the order does not involve the physical delivery of any product, the contracted services being downloaded or activated directly from the website, the PROVIDER will inform the USER in advance of the procedure to follow for that download or activation.
Failure to perform the distance contract
In the case of the provision of a service, it will be available from the moment the USER has paid for it and may be downloaded or activated in accordance with the PROVIDER’s conditions.
If the contract cannot be performed because the contracted service is not available within the expected period, the USER will be informed of the lack of availability and of their entitlement to cancel the order and receive a refund of the full amount paid at no cost, without this giving rise to any liability for damages attributable to the PROVIDER.
The PROVIDER will accept no liability where the download or activation of the service does not take place because the data provided by the USER is false, inaccurate or incomplete.
The service will be deemed to have been provided at the moment the USER has downloaded or activated it.
3. RIGHT OF WITHDRAWAL
Individual users:
The USER has fourteen calendar days, counted from the date the product is received or from the conclusion of the sale contract in the case of the provision of a service, to exercise the right of withdrawal governed by article 102 of Spanish Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Act for the Defence of Consumers and Users and other supplementary legislation, hereinafter RDL 1/2007.
If the PROVIDER fails to comply with its duty to provide information and documentation about the right of withdrawal, the period for exercising it will end twelve months after the date on which the initial withdrawal period expired, in accordance with article 105 of RDL 1/2007.
The USER may, however, exercise their right of withdrawal within that period provided that they have not downloaded the files associated with the service.
Otherwise, and as set out in article 103 of the aforementioned Royal Decree, exception m): “the supply of digital content not supplied on a tangible medium where performance has begun with the consumer’s prior express consent and their acknowledgement that they thereby lose their right of withdrawal”, the right of withdrawal from the contract may not be exercised.
The USER may request withdrawal from their order using the online withdrawal function available at Exercise your right of withdrawal.
Once the PROVIDER has reviewed whether a refund to the USER is appropriate, it will notify the USER as soon as possible, refunding the amounts paid and cancelling the order.
Business users:
The USER is reminded that the right of withdrawal applies only to end consumers, not to companies, and only to certain products or services.
4. COMPLAINTS AND ONLINE DISPUTE RESOLUTION
Art Project Group Developers SL states that it has official Complaint Forms available to any user or consumer who requests them. They can be obtained by requesting them through any of the contact details given below.
We remind you that, even if it is not made through an official Complaint Form, any complaint the user or consumer sees fit to make will be dealt with as soon as possible:
- Postal address: Art Project Group Developers SL. C/ Álvaro Mutis 1, 4ºG. Mijas. Postcode: 29651. Málaga (Spain).
- Telephone: 952 665 664.
- Email: [email protected].
Online Dispute Resolution
The online dispute resolution platform that the European Commission maintained under Regulation (EU) 524/2013 ceased to operate on 20 July 2025, by virtue of Regulation (EU) 2024/3228, which repealed that Regulation. That route is no longer available, so the USER may address their complaints to the customer service email address and telephone number given below.
Should any dispute arise in relation to your purchase, our main aim is to reach an amicable solution. We invite you to contact our Customer Service Department through the channels given below, where we will do everything we can to resolve your concern satisfactorily:
- Postal address: Art Project Group Developers SL. C/ Álvaro Mutis 1, 4ºG. Mijas. Postcode: 29651. Málaga (Spain).
- Telephone: 952 665 664.
- Email: [email protected].
If we cannot resolve the dispute amicably, please note that, although our company is not obliged by any rule or code of conduct to submit to any alternative dispute resolution (ADR) scheme, out-of-court alternatives do exist for resolving consumer disputes (the Spanish Consumer Arbitration System, consumer mediators and the municipal consumer information offices, OMIC). These schemes offer a quick and inexpensive way of resolving disputes.
In any event, if no satisfactory agreement is reached through the channels mentioned above, both you and our company retain the right to go to the ordinary courts to resolve the dispute, in accordance with the legislation in force.
Complaint forms
The PROVIDER states that it has official Complaint Forms available to any user or consumer who requests them. We remind you that, even if it is not made through an official Complaint Form, any complaint the user or consumer sees fit to make will be dealt with as soon as possible.
They can be obtained by requesting them through any of the contact details given above.
5. FORCE MAJEURE
The parties will incur no liability for any failure due to force majeure. Performance of the obligation will be deferred until the force majeure event ends.
6. JURISDICTION
The USER may not assign, transfer or convey the rights, responsibilities and obligations contracted in the sale.
If any provision of these conditions is held to be void or impossible to perform, the validity, legality and performance of the rest will not be affected in any way, nor will they be modified in any way.
The USER declares that they have read, understand and accept these Conditions in their entirety.
7. GENERAL TERMS OF THE OFFER
All sales made by the PROVIDER will be understood to be subject to these Conditions.
No modification, alteration or agreement contrary to the Commercial Proposal of Art Project Group Developers SL or to what is stipulated here will take effect unless expressly agreed in writing and signed by the PROVIDER, in which case those particular agreements will prevail.
Given the continuous technical advances and improvements to the services, the PROVIDER reserves the right to modify their specifications with respect to the information given in its advertising, so long as this does not affect the value of the services offered. These modifications will also be valid where, for any reason, the ability to supply the services offered is affected.
8. PRICE AND PERIOD OF VALIDITY OF THE OFFER
The prices shown for each service include Value Added Tax (VAT) or any other taxes that may apply.
The prices applicable to each service are those published on the website and are expressed in EUROS. The USER accepts that the price of some of the services may vary in real time.
Before making the purchase you can check all the details of the quotation online: services, quantities, price, availability, charges, discounts, taxes and the purchase total. Prices may change daily until the order is placed.
Once the order has been placed, the prices will be held whether or not the service is available.
Every payment made to the PROVIDER involves the issuing of an invoice in the name of the registered USER or of the company name the USER gave when placing the order. This invoice will be sent as a PDF to the email address provided by the USER, provided that the USER has given express consent to this, and the USER is informed that this consent may be withdrawn at any time by notifying the PROVIDER through any of the channels made available.
For any information about the order, the USER may contact the PROVIDER’s customer service telephone number 952 665 664 or by email at [email protected].
9. SHIPPING COSTS
There are no shipping costs.
10. PAYMENT METHODS, CHARGES AND DISCOUNTS
The PROVIDER is responsible for the financial transactions and offers the following ways of paying for an order:
- Bank transfer to our account (the details are sent once the order is placed).
- Credit card. Secure payments through the Cajamar payment gateway (Redsys).
The USER may use a discount coupon just before completing the purchase, where one has been received from the PROVIDER.
Security measures
The website uses information security techniques generally accepted in the industry, such as SSL, data entered on a secure page, firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to the data. To achieve this, the USER accepts that the PROVIDER may obtain data for the purpose of authenticating access controls.
The PROVIDER undertakes not to allow any transaction that is, or is considered, illegal by the credit card brands or the acquiring bank, or that may damage their goodwill or affect them adversely.
The following activities are prohibited under the card brand programmes: the sale or offering of a product or service that does not comply with all the laws applicable to the Buyer, Issuing Bank, Merchant or Cardholder.
11. SUBSCRIPTIONS AND AUTOMATIC RENEWAL
The software licences that the PROVIDER sells as a subscription last one year from the date of purchase and renew automatically for equal periods until the USER cancels them. Each period includes one year of technical support and one year of updates.
Consent and stored card
When buying a subscription, the USER expressly accepts, through a specific checkbox in the purchase process, that the PROVIDER stores their card and charges it automatically on each renewal date. Subscriptions can only be paid by card.
The card is stored encrypted in the Cajamar payment gateway (Redsys). The PROVIDER never knows or stores the full card number, only a reference, the last four digits and the expiry date. The first payment is authenticated with the issuing bank’s security system (3D Secure) and renewal charges are made without the USER having to authenticate again, under this consent.
The PROVIDER stores in each order the text accepted, the date and the IP address from which it was accepted, and the USER receives a copy in the order confirmation email.
Renewal price and notices
The renewal is charged at the renewal price in force shown on the product page, taxes included. The PROVIDER will notify the USER by email 30 days and 7 days before each renewal, stating the date and the amount of the charge.
If the renewal price changes, the PROVIDER will notify the USER at least 30 days before the renewal date, and the USER may cancel the subscription before that date at no cost.
Cancellation
The USER may cancel the subscription at any time from My account › Subscriptions or by writing to [email protected]. Cancellation stops future charges, and the licence keeps working until the end of the period already paid for and is then deactivated. To avoid the next renewal charge, you must cancel before the renewal date.
Cancelling does not give a right to a refund for the current period, without prejudice to the right of withdrawal in clause 3 where applicable.
If the PROVIDER refunds the full amount of an order, the licence paid for with that order is deactivated at that moment and the subscription is cancelled, so that no further charge will be made.
Failed payments
If the bank declines the renewal charge, the subscription remains on hold for 3 days and the licence keeps working. During that time the PROVIDER may retry the charge once a day and will notify the USER by email so that they can pay the renewal order or update their card from My account › Payment methods. If the payment has not been completed by the end of that period, the subscription is cancelled and the licence is deactivated.
In accordance with Visa and Mastercard rules, if the issuing bank indicates that the card is no longer valid or that the operation must not be repeated, the PROVIDER will not charge that card again: it deletes it and notifies the USER. If the bank indicates that it is necessary to wait, the charge will not be retried before 72 hours have passed.
If the USER has no stored card, for example because it has expired, the PROVIDER will notify them by email in advance. If there is still no card the day before the renewal, the subscription will be cancelled so as not to attempt a charge that cannot be completed, and the licence will work until the end of the period paid for.
12. PURCHASE PROCESS
Basket (quotation simulation)
Any service in our catalogue can be added to the basket. The basket shows only the services selected, the quantity, the price and the total amount. Once the basket is saved, the taxes, charges and discounts are calculated according to the data entered.
Baskets have no administrative effect; they are simply a place where a quotation can be simulated with no commitment on either side.
An order can be placed from the basket by following these steps so that it is properly completed:
- Checking the billing details.
- Selecting the payment method.
- Placing the order (buying).
Once the order has been processed, the system instantly sends an email to the PROVIDER’s administration department and another to the USER’s email address confirming that the order has been placed.
Orders (purchase requests)
Within a maximum of 24 hours on working days, an email will be sent to the USER confirming the status of the order and the approximate download and/or activation date.
13. SEVERABILITY AND SUSPENSION OR TERMINATION OF THE CONTRACT
If any of these terms and conditions is held to be unlawful, void or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any of the remaining conditions.
Art Project Group may, without prior notice, suspend or terminate the USER’s access to its services, in whole or in part, for any valid reason, including without limitation where the USER fails to comply with or follow any of the obligations set out in this document or any applicable legal provision, licence, regulation, directive, code of practice or usage policy.
Where Art Project Group exercises any of its rights or powers under this Clause, such exercise will not prejudice or affect the exercise of any other right, power or remedy that may be available to Art Project Group.
14. WARRANTIES AND REFUNDS
The warranty period for the main software (included in the licence) is 1 year.
The warranty period can be extended by purchasing service packages or licence renewals.
15. APPLICABLE LAW AND JURISDICTION
These conditions will be governed by and interpreted in accordance with Spanish law in anything not expressly provided for. Any dispute that may arise from the provision of the products or services covered by these Conditions will be submitted to the courts of the USER’s domicile, of the place of performance of the obligation, or of the place where the asset is located if it is immovable property.
